Scope of Services:
Ewart Construction Inc. agrees to provide renovation services as agreed upon in the written estimate or contract.
Project Proposal:
The project estimate/contract outlines the scope of work, timeline, and cost. Any modifications additions to the project must be agreed upon in writing and signed as a change order number.
Payments:
Payment details are outlined in the estimate or contract. However, Payments are due according to the agreed-upon schedule, due upon receipt, if payment is not paid in full within 7 days, work will stop until payment, if work is finished then item 11 of these terms will come into effect.
Changes to Scope:
Any changes to the project scope must be mutually agreed upon in writing, including adjustments to cost, schedule, warranty and documented as a CO# (change order number).
Permits and Approvals:
It is the client's responsibility to obtain any necessary permits or approvals for the renovation project unless otherwise specified in the contract.
Delays:
Ewart Construction Inc. is not responsible for delays due to unforeseen circumstances such as weather, permits, logistics or other issues beyond our control.
Quality Assurance:
We strive to deliver high-quality workmanship. Any defects or issues must be reported within 10 days of project completion, and if verified and agreed by PBR we will rectify them promptly.
Warranty:
Our work is backed by a 1-year warranty, for projects covering defects arising from our workmanship. This does not cover damage caused by misuse, neglect, or external factors, acts of God.
Termination:
Either party may terminate the contract with written notice if the either party breaches the terms. In the event of termination, the client is responsible for payment of work completed.
Confidentiality:
Both parties agree to keep all project-related information confidential, excluding situations where disclosure is required by law.
Dispute Resolution:
Any disputes arising from this agreement will be resolved through mediation. If mediation is unsuccessful, either party may pursue Arbitration, if all work is completed the legal action will take precedence.
Governing Law:
This agreement is governed by the laws of British Columbia.
